Georgia Premises Liability – Negligent Maintenance

Owners and occupiers of real property in the state of Georgia have a duty to exercise ordinary care to keep their premises and approaches safe.  This includes a duty to make a reasonable inspection of the premises for potentially hazardous conditions.  If and when such conditions are found, and are not open or obvious, the owner/occupier has a duty to either make the hazard safe, or to warn invitees of its existence.  If the owner/occupier is negligent when inspecting the premises, making a hazard safe, or warning of a hazard, he or she can be held liable by any invitees who are injured as a result of that negligent failure to maintain the property in a reasonably safe condition.
